All Indian Passport holders are aware of the acronyms ECR passport and ECNR passport. What are these? These are the stamps that are put on the passport from the office of POE- Protectors of Emigration. if you are going abroad for employment. and you have ECR in your Passport. you are going to face too much difficulty.

Here we are going to explain the process, how to change ECR to ECNR in Indian passport?

 

 

ECR in Passport

What is ECR in Passport: Emigration Check Required are passports issued before January 2007. These passports will be endorsed with the ECR(emigration check required) from POE office.

What is ECNR in Passport: Emigration Check Not Required are passports issued after January 2007. These passports will be endorsed with the ECNR from POE office.

What is the non-ECR Category in Passport: ECNR Passport comes in non-ECR (emigration check required) category in passport. So If you have ECNR passport it means that will come in non-ECR(emigration check required) category.

ECR(emigration check required) passport countries- the following is the list of those countries for which ECNR can work for from India-

Documents Required for Non-ECR (ECNR)

Diplomatic Passport Holder: All holders of Diplomatic/Official Passports No separate document is required except Diplomatic passport.

All Government Servants: All GAZETTED Government servants, their spouses and dependent children.

  1. For Gazetted Government servants
     i) Identity Certificate as per Annexure A OR
    ii) No Objection Certificate as per Annexure G OR
    iii) Prior Intimation Letter (PI) as per Annexure H
  2. For spouses of gazetted government servants
    i) Identity Certificate as per Annexure A OR
    ii) An attested copy of marriage certificate issued by Registrar of
  3. For dependent children of gazetted government servants
    i) Identity Certificate as per Annexure A OR
    ii) Birth Certificate issued by Municipal Authority or any office authorized to issue Birth Certificate by Registrar of Births and Deaths OR
    iii) School leaving certificate / Secondary School leaving certificate/ Certificate of Recognized Boards from the school last attended by the applicant or any other recognized educational institution OR
    iv) Passport copy of the government servant

All persons having educational qualifications of matriculation and above Matriculation or Higher Educational Pass Certificate

Age of 50 Years: All persons above the age of 50 years

  1. Birth Certificate issued by the Municipal Authority or any office authorized to issue Birth and Death Certificate by the Registrar of Births & Deaths OR
    ii) School leaving certificate / Secondary School leaving certificate/ Certificate of Recognized Boards from the school last attended by the applicant or any other recognized educational institution

For Children: All children up to the age of 18 years. (For re-issue of passport, after they attain the age of 18 years, documents to prove their non-ECR category has to be submitted, else ECR stamping will be done)

Birth Certificate issued by Municipal Authority or any office authorized to issue Birth Certificate by Registrar of Births and Deaths Income-Tax payers (including Agricultural Income-Tax payers) in their individual capacity, their spouses and dependent children below the age 18 years

  1. i) Proof of assessment of income tax and actual payment of income tax for last one year OR
    ii) Income Tax return statement (with income tax being paid by the applicant) for last one year that is stamped by income tax authorities and a copy of the PAN card
    Note:
    i) Proof of payment of advance tax is not sufficient. You need to submit additional documents as specified above
    ii) Applicants submitting the NILL income tax return statements are not eligible.
  2. For spouses, a certificate signifying relation
    i) An attested copy of the marriage certificate issued by the Marriage Registrar needs to be submitted. For verification, spouse's name needs to be endorsed in the applicant's passport. OR
  3. For dependent children certificate signifying relation
    i) Birth Certificate issued by Municipal Authority or any office authorized to issue Birth Certificate by Registrar of Births and Deaths OR
    ii) School leaving certificate / Secondary School leaving certificate/ Certificate of Recognized Boards from the school last attended by the applicant or any other recognized educational institution

For Diploma Holder: Persons possessing two years diploma from any institute recognized by the National Council for Vocational Training (NCVT) or State Council of Vocational Training (SCVT), or persons holding three years diploma/equivalent degree from institutions,

such as Polytechnics recognized by the Central/State Governments of India Pass Certificate issued by the Institute

For Nurses: nurses possessing qualifications recognized under the Indian Nursing Council Act. 1947 Nursing Certificate
All Degree Holders: All professional Degree holders, their spouses, and dependent children. Examples of professional degree holders are Doctors holding MBBS degree or equivalent degree in AYURVED or HOMEOPATHY, accredited Journalists, Engineers, Chartered Accountants, Cost Accountants, Lecturers, Teachers, Scientists, Advocates, etc

  1. Certificate of the professional degree held
  2. For spouses, certificate signifying relation
    i)An attested copy of the marriage certificate issued by the Marriage Registrar needs to be submitted. For verification, spouse's name needs to be endorsed in the applicant's passport.
  3. For dependent children certificate signifying relation
    i) Birth Certificate issued by Municipal Authority or any office authorized to issue Birth Certificate by Registrar of Births and Deaths OR
    ii) School leaving certificate / Secondary School leaving certificate/ Certificate of Recognized Boards from the school last attended by the applicant or any other recognized educational institution

Living Abroad More Than 3 Years: All persons who have been staying abroad for more than three years (the period of three years could be either in one stretch or broken) and their spouses

  1. Passport copy (first two and last two pages, including ECR/Non-ECR page and the page of observation (if any), made by Passport Issuing Authority)
  2. For spouses certificate signifying relation
    i)An attested copy of marriage certificate issued by Registrar of Marriage OR
    ii)Spouse name should be endorsed on each others passport
  3. An applicant has to submit a written statement detailing all the dates of exit and entry into India and produce the passport for verification. (Format: Sl. No, Date of Exit. Port of Exit, Page Number of passport containing the stamp, Similarly details of the corresponding entry.
    The last column should mention the number of days spent outside India. This should be more than three years (1095 days).

For CDC: Seamen who are in possession of Continuous Discharge Certificate (CDC), or Sea Cadets and Deck Cadets

  1. Who have passed the final examination of three years B.Sc. Nautical Sciences courses at T.S. Chanakya, Mumbai and
  2. Who have undergone three months of pre-sea training at any of the Government approved training institutes, such as T.S. Chanakya, T.S. Rehman, T.S. Jawahar, MTI (SCI) and NIPM, CHENNAI, after production of identity cards issued by the Shipping Master at Mumbai/Kolkata/Chennai

Continuous Discharge Certificate

FOR PR Holder: Persons holding Permanent Immigration Visa, such as the visas of UK, USA and Australia. Copy of Immigration Visas, or the Permanent Resident card of the country of stay

Note: If the applicant does not have Non-ECR status then All such ECR passport holders need to obtain an Emigration Clearance Certificate from the Protector-General of Emigrants, Ministry of Overseas India Affairs.

Fees for Deletion of ECR

1. Replacement of Passport (36 pages) for deletion of ECR / Change in personal particulars (10-year validity) – Application Fee - Rs. 1,500/-       Additional Tatkal Fee - Rs.2,000/-
2. Replacement of Passport (60 pages) for deletion of ECR / Change in personal particulars (10 year validity) Application Fee - Rs. .2,000/- Additional Tatkal Fee - Rs.2,000/-

3. Replacement of Passport (36 pages) for deletion of ECR/ Change in personal particulars for Minors (below 18 Years of Age), of 5 years validity or till the minor attains the age of 18 whichever is earlier. Application Fee - Rs. 1,000/- Additional Tatkal Fee - Rs.2,000/-

Note: This above Fee is non-refundable.

The following persons are not subject to ECR(emigration check required) passport even if they are traveling to the above-mentioned countries-

  • The Gazetted officers.
  • Diplomatic and official passport holder.
  • The income taxpayers.
  • Professional degree holder like MBBS or degree in engineers etc.
  • Spouse and dependent children (up to 24) of the above-mentioned persons.
  • The persons having qualified the 10th standard and more than above.
  • Seaman has CDS or sea cadets and have passed the final examination of three years in Nautical Sciences Courses from the following institutes- S Chanakya, S Rehman, S Jahawar, MTI, Chennai, NIPM, Chennai
  • Those who have permanent immigration visas such as of the UK, USA, and Australia.
  • Those who are having diploma or degree in Polytechnics.
  • Those who have done diploma of nursing under Indian Nursing Council Act, 1947.
  • Those who are more than 50 years.
  • Those who have spent their 3 years abroad with their spouses.
  • Children under 18 years with any of one or both parents.

Step by Step Process to Delete ECR Stamp

The process of removing ECR(emigration check required) passport seal and obtaining the ECNR status- It is necessary to remove the ECR(emigration check required) seal because it is basically for those who are going abroad for employment reasons.

If someone hasn’t removed the ECR(emigration check required) seal in passport while ECNR is enough that she/he must be questioned.

She/he can face troubles. So it's important to remove ECR(emigration check required) seal in Passport and obtain ECNR status before your journey. The process is like this-

Step 1:  Download the application form miscellaneous service from passport.gov.in

Step 2:  You have to mention the request of ‘Deletion of ECR(emigration check required) in passport’ in the form.

Step 3: Attach two photocopies of 10th, 12th and college degree.

Step 4: Make sure your Certificate copy should be attested.

Step 5: Attach proof of address also (Ration card/Voter Id/Lease agreement/Bank statement/ Electricity, Phone bill, Employer Id).

Step 6: Sometimes PAN card is also required.

Step 7: Applicable Fee you have to pay as per the above list./

Step 8: Submit your present passport along with 2 photocopies of the last and first 4 pages of it.

Step 9: Submit the form along with the documents at your nearest passport office center.

After submitting your passport in the passport office. you will get your updated passport from ECR(emigration check required) to ECNR within seven to ten working days.

Q:   How can I check ECNR or ECR for a passport?

A:   If you submit your 10th certificate When you applied for the passport. Then your passport will be ECNR. It’s very simple.
